Did you know that buying a home is the largest purchase most people will ever make, yet, I can count on one hand the number of clients each year that obtain legal advice prior to executing the final Agreement of Purchase and Sale, despite the fact that it is a binding legal document. Most if not all of the Agreements of Purchase and Sale contain conditions for financing and inspection, why not include a condition that it be conditional upon your reviewing same with a lawyer?
In most cases, when an issue does arise later in the process (which may have been dealt with prior to the signing of the Agreement of Purchase and Sale had it been reviewed by a lawyer), the lawyer must refer to the contract and whatever that contract states is binding. It does not matter that the matter could have been handled differently had the Agreement been reviewed prior to its final execution. A contract is a contract.
